For sale by public online auction, closing on Wednesday 14th June 2023 at 12 noon.An attractive parcel of undulating pasture extending to 9.83 acres or thereabouts, situated on the edge of Kilsby.

Situation
The land has road frontage and is situated on the eastern side of Watling Street (A5) leading south of the village of Kilsby.

Access can be gained via one of two gated entrances off the hardcore track situated along the southern boundary. The land has frontage along the western boundary and surrounds the Kilsby tunnel on west coast main rail line, which runs beneath the land.

Description
The land extends to approximately 9.83 acres bordered by a mixture of post, stocking netting fencing and mature trees to three sides. The northern boundary is enclosed by palisade security fencing, with Network Rail being responsible for maintenance.

Adjacent to the northern boundary is Kilsby tunnel, which runs underneath the parcel of land. A mains fed water trough is situated along the southern boundary in the south-west corner of the land.

The land is classified as Grade 3 on the Agricultural Land Classification Maps, being a slowly permeable base-rich loam and clay soil.

Tenure & Possession
The land is sold freehold with vacant possession being given upon completion.

A grazier currently occupies the land under a grazing licence, however vacant possession will be given upon completion.

Development Uplift
The property will be sold subject to a development uplift clause which will reserve 30% of any increase in value due to any non-agricultural non-equestrian development that takes place within a period of 30 years from the date of sale.

This clause will be triggered either upon the implementation of a planning consent or the sale of the property following planning consent. For the avoidance of doubt any agricultural buildings or stables or equestrian facilities constructed and used for this purpose would not trigger the clawback clause.

Services
The property benefits from mains water which feeds a trough to the south west corner of the land. The purchasers should note it is their specific responsibility to investigate the availability of the services.

Wayleaves, Easements and Rights of Way
The land will be sold with all wayleaves, easements and rights of way which may affect or benefit this property.

Restrictive Covenants
Not at any time thereafter to build, erect or place or allow to be built, erected or placed on the Property or any part thereof any hut, tent, temporary dwelling, caravan, house on wheels or encampment intended for use as a dwelling.

Plan, Area & Description
The plan, area and description are believed to be correct in every way, but no claim will be entertained by the vendor or agents in respect of any error, omissions or misdescriptions. The plan is for identification purposes only.
